Let’s start off 2026 with a review of what’s been going down in the courts:
👺Court Purgatory
These states are stuck in legal limbo, AKA bans are still being challenged, partially enforced, appealed, paused, un-paused... it’s giving courtroom chaos: NC, GA, SC, TN, KY, IN, MO, WY, UT. That means docs and patients don’t know if they’re breaking the law or just doing healthcare. COOL!
🚫 Abortion Access Getting Yeeted Out of 2026
These states upheld bans and restrictions, doubling down on putting providers and patients in harm’s way: ID, ND, IA, OK, FL.
🟢 Courts Giving Us Abobo Wins
States where courts actually upheld abortion rights under state law and are open to hearing arguments this year to protect abortion access?! In THIS country?! YUP! WI, MI, OH, AZ. Your job? Support the SHIT out of the folks working to make this happen.
🧨 And just last week… Cheeto-in-Chief banned abortion care for veterans NO MATTER WHERE THEY ARE! Because apparently, not even federal healthcare is safe from this shitstorm.
The Headline: These states could shape abortion access in 2026
🗳️ABORTION BALLOT-PALOOZA
If it’s 2026, it’s MIDTERM MANIA, BABY. And THAT means states are teeing up voters for abortion ballot proposals that could EXPAND or RESTRICT abortion access. The outcome could totally change the landscape of access in this country ONCE AGAIN. No presh.
👀 States To Watch
Nevada, Idaho, Oregon, and Virginia all have initiatives that would claw back crumbs of access or supercharge their already existing protections. On the flip, Nebraska has one that would define fetuses as people, and Missouri’s would REVERSE protections that voters JUST approved. Sore-ass losers.
🔁We’ve Done it Once, We’ll Do It Again
In the last midterms in 2024, SEVEN states voted to protect abortion. Abortion is still popular as fuck, a majority of Americans support access. So it’s officially time to dust off the old clipboards and get to organizing, showing up, and VOTING.
